The petitioner claims that her husband has died under mysterious circumstances. The private respondent, family members, initially registered a case of suicide. After the petitioner's complaint, FIR No.695 of 2022 dated 30th August, 2022 under section 306 and 34 of the IPC has been registered by the Domjur Police. The private respondents have obtained bail.

Learned counsel for the private respondents submits that the father-in-law of the petitioner had always dividend properties equally between his three sons, which included the deceased husband of the petitioner. They have absolutely no objection to the petitioner and her minor children returning to their house. They undertake to take good care of them. The petitioner herself should integrate with the family.

Let the investigation into the pending FIR be completed as expeditiously as possible preferably within a period of two months from date.

Let a copy of the post mortem report be made available to the petitioner.

In the event, the petitioner sees any further threat to her person or child, she may apply before the Commissioner of Police, Howrah City Police.

Upon receipt of such complaint, the Commissioner of Police, Howrah City Police shall cause an enquiry and take steps thereupon in accordance with law.

Domjur Police shall, however, ensure that there is absolutely no breach of peace in the area.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

The report of the Inspector-in-Charge, Domjur Police Station, Howrah City Police dated 3rd July, 2023 is taken on record.
