Mr. Tapan Dutta Gupta Mr. Parvej Alam Ms. Rituparna Ghosh Mr. Sourav Sardar ...for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 2nd Court, Basirhat to dispose of Title Suit No.252 of 2019 expeditiously.

The learned advocate appearing for the petitioner submits that the suit is pending from the year 2019 and several interlocutory applications are also pending. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. From the order sheets appended to this application, this Court finds that a petition dated February 19, 2025 and two other petitions dated May 5, 2025 are pending

and the learned trial judge fixed July 10, 2025 for hearing of the petitions.

The learned advocate appearing for the petitioner submits that aforesaid petitions are still pending. In the light of the submissions made by the learned advocate for the petitioner, CO 2426 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Div.), 2nd Court, Basirhat to make an endeavour to take up the hearing of the interlocutory applications on the next date fixed, is the same are otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
