We notice a most undesirable state of affairs. The memorandum of appeal was filed in this court sometime in 2015 and thereafter no steps have been taken by the appellant to prosecute the appeal.

Mr. Ganguly, learned advocate appearing for the respondent /decree holder submits that because of pendency of this appeal, the learned court below has not taken any steps further to the decree.

In those circumstances, we dismiss the appeal for non-prosecution.
