Mr. Abhijit Sarkar Mr. Raja Biswas .....for the petitioner Mr. Kamal Kumar Chattopadhyay ......for the State The present writ application has been preferred alleging inaction on the part of the Municipal Authorities in not giving water connection to the premises of the petitioners.

It is submitted by the learned counsel for the petitioner that during pendency of the writ application the petitioner no. 1 has expired.

It is prayed that the prayer of the petitioner no. may be considered by the Municipality in accordance with law.

Death certificate in respect of the petitioner no. 1 has been filed along with an affidavit. Let it be kept with the record.

It is now submitted that the respective authorities may be directed to consider the application of the petitioner no. 2.

Shri Bimal Pramanick, learned counsel for the State is present virtually.

None appears for the Municipality.

Considering the said facts and the materials on record the writ application dispose of with the direction that the Tamluk Municipality being the respondent no. 2 is directed to consider the representation dated 29.04.2019 submitted by the petitioner before the authority concerned.

The Chairman being the respondent no. 2 shall consider the said representation within 30 days from the date of communication of this order.

Considering that water supply is an essential commodity the representation shall be considered in accordance with law, by giving an opportunity of hearing to the petitioner herein.

A reasoned order be passed by the authority concerned.

In case a copy of the representation is not available with the respondent no. 2, the petitioner is at liberty to place a copy of the same before the respondent no. 2 for consideration.
