Ahsanuzzaman ...for the State The petitioner was appointed as a Gram Panchayat Secretary at Barnia Gram Panchayat under the Tehatta-II Development Block on September 25, 1987. Subsequently, he was transferred to Pipulbaria Gram Panchayat under the Karimpur-I Development Block on March 7, 2001. During his tenure under the said Gram Panchayat, a complaint was lodged by the Block Development Officer, Karimpur-I Development Block, alleging misappropriation of Panchayat funds. Pursuant to the said complaint, a criminal case, being Case No. 24/02, was registered against the petitioner at Murutia Police Station on May 3, 2002, under Section 409 of the Indian Penal Code. Consequently, the petitioner was placed under suspension on July 17, 2002, and remained so until July 31, 2012, when he attained the age of sixty years.
The petitioner was subsequently acquitted by the competent Criminal Court under Section 235(1) of the Code of Criminal Procedure, 1973, on September 27, 2022.
Narrating the aforesaid factual background, Mr. Lahiri, learned advocate appearing for the petitioner, submits that although the petitioner was paid subsistence allowance during the period of suspension, he has not been paid any retiral benefits, including pension, gratuity, or leave salary. Mr. Lahiri has further drawn the attention of this Court to a letter dated May 31, 2023, issued by the Block Development Officer, Karimpur-I Development Block, addressed to the District Panchayat and Rural Development Officer, Nadia.
In view of the foregoing circumstances, I find no justification to keep this writ petition pending. Accordingly, the District Panchayat and Rural Development Officer, Nadia, is directed to furnish the requisite particulars to the Block Development Officer, Karimpur-I Development Block, in response to the letter dated May 31, 2023, within a period of two months from the date of communication of this order.
Needless to mention, upon receipt of the requisite particulars from the District Panchayat and Rural Development Officer, Nadia, the concerned Block Development Officer, Karimpur-I Development Block, shall take necessary steps in accordance with law to release the petitioner's terminal dues, if any, as expeditiously as
possible.
WPA 14966 of 2025 stands disposed of accordingly. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
