Learned advocate representing the State respondents has obtained instruction and has produced the copy of the register of attendance of Civic Volunteers. It appears therefrom that the petitioner was marked absent for the period April 23, 2023 to May 28, 2023. The resignation of the private respondent was accepted on May 28, 2023 and from that date his name has been struck off from the list of Civic Volunteers. The duty detailment which has been annexed to the writ petition appears to be an old one, not updated by the concerned authority. The copy of the duty register, which is maintained physically in the office of the concerned authority is an updated one.

In view of the above, the allegation of the petitioner that the private respondent being a Civil Volunteer is ineligible to contest the Panchayat General Elections,

2023 cannot be accepted. The private respondent is not a Civic Volunteer as alleged.

The writ petition stands disposed of.

The documents produced by the learned advocate representing the State respondents be retained with the records.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
