Mr. Radhasyam Maiti Mr. Manoranjan Jana .... for the petitioners Mr. Arindam Chattopadhyay Ms. Lipika Chatterjee ......... for the State Mr. Bhaskar Prasad Vaisya Mr. Gourav Das .... for the respondent No.3 The grievance of the petitioners is that several prayers made by the petitioners for transfer from their present schools to the schools requested has not been considered or responded to by the concerned respondents. The representations dated 21st February, 2019 and 20th February, 2020 have been placed before the Court.

Learned counsel appearing for the Council submits that the representations may be considered provided it is addressed to the appropriate authority. Upon hearing learned counsels, this Court is of the view that the representations which are already on record, namely to the Teacher-in-Charge and SubInspector of Schools, South 24 Parganas and to the

District Inspector of Schools may be considered by the respondent No. 3 who is the Chairman of the District Primary School Council, South 24 Parganas. The respondent No. 3 will consider the representations upon hearing all concerned persons including the petitioners and pass a reasoned order within a period of eight weeks from the date of communication of this order. A copy of the reasoned order shall be furnished to the petitioners within two weeks from date on which the order is made. It is also made clear that in the event the petitioners are found to be eligible for transfer under the relevant rules and notifications, the concerned respondents shall take expeditious steps in that regard. WPA 16341 of 2021 is disposed of in terms of the above direction.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
