Criminal Miscellaneous Jurisdiction 3.8.2022 S.D Item no.3 CRM (DB) 2378 of 2022 Chiranjib Banerjee -VsSP, CBI, EO-IV, 3rd Floor, Kolkata, CGO Complex Sector-I, DF Block, A-Wing, Salt Lake, Kolkata-64 Mr. Jayanta Banerjee Mr. Joy Chakraborty ...For the petitioner. Mr. Anirban Mitra .... For the CBI. The petitioner is in custody for 2 and 1⁄2 years, being arrested on 7th October, 2020. He is accused of being involved in a large ponzi scam. Since chargesheet has been filed it is to be presumed investigation is over.

However, learned counsel appearing for the CBI submits that certain incriminating materials have been found and that the agency shall file a supplementary chargesheet. He opposes the prayer of the petitioner for being enlarged on bail. Considering the above submissions, we grant time to the investigation officer to complete whatever cause of investigation that is necessary and file a supplementary chargesheet by 16th September, 2022. On and from 17th September, 2022 the petitioner shall be enlarged on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount, one of whom must be local, to the satisfaction of the learned Additional District and Sessions Judge, 2nd Court Hooghly subject to the following conditions:-

1. The petitioner is to deposit his passport, if he has one, with the investigating agency within three days from date;

2. He will meet the investigating officer as and when summoned

3. He shall not leave the limits of Bankura District, without informing the investigating officer.

4. He shall not tamper with evidence or interfere with the witnesses in any manner.
