Petitioner is directed to serve a copy of the revisional application upon Mr. Anwar Hossain, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities.

Learned advocate for the petitioner submits that the petitioner is in custody since 23rd August, 2022 and charge-sheet has already been submitted before the learned court on or about February, 2023.

It has been submitted that there are 21 witnesses on whom the prosecution proposes to rely in support of its case out of which 17 witnesses belong to Government department and learned trial court has fixed 18th September, 2023 as the next date for consideration of charges.

I have considered the submissions advanced by the learned advocate appearing for the petitioner and having regard to the fact that the petitioner is in custody and 21 witnesses have been

proposed to be relied upon by the prosecution to establish its case, I am of the opinion that the learned trial court should frame the charges on the next date so fixed, i.e. 18.09.2023 or within a week thereafter. The learned trial court would thereafter fix at least a schedule consisting of three dates once in every 45 days so that the trial can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties and in case any witness is reluctant to appear before the court, notice be sent to the Superintendent of Police of the concerned district so that the appearance of the witnesses may be ensured on the date so fixed. The learned public prosecutor conducting the trial would take steps for production of the materials, exhibits and documents on the date so fixed for examination of the witnesses. All stakeholders should co-operate with the learned trial court so that the trial is concluded at the earliest.

With the aforesaid observations, CRR 2379 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
