Affidavit of service filed in Court today is taken on record.

The petitioner alleges that the private respondents are illegally filling up a water body and making construction thereon.

3.

Objection filed by the petitioner before the authority is pending consideration for a considerable period of time.

Learned advocate appearing on behalf of the private respondents denies the allegation of the petitioner.

It has been submitted that the subject land is neither a water body nor classified as water body.

6.

Learned advocate appearing on behalf of State respondents is yet to receive any instruction in the matter.

As it appears that the objection filed by the petitioner is pending consideration before the respondent authority, accordingly, the instant writ petition is disposed of by directing the Sub-Divisional Officer, Islampur being the respondent no. 10 herein to consider and decide the objection filed by the petitioner in accordance with law at the earliest by granting reasonable opportunity of hearing to all the necessary parties and by passing a reasoned order. The parties shall be permitted to rely upon documents in support of their respective stand.

Steps shall be taken in the matter at the earliest but positively within a period of twelve weeks from the date of communication of this order.

Learned advocate appearing on behalf of the petitioner is directed to forward a copy of the objection signed by the petitioner on 7th March, 2024 to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
