Mr. Lakshmi Kanta Pal Mr. Bandhu Brata Bhula ...for the petitioner Mr. Swapan Kumar Datta Mr. Rajat Datta ...for the State The case of the petitioner is that he obtained Ph.D. degree after filing of his application for the post of teacher but before appointment. Regarding this, the school wrote to the concerned District Inspector of Schools for considering these additional two increments - one in 2013 and then in 2017, but nothing happened in respect of those two letters of the school which have been annexed in the writ application.

At last, the petitioner made a representation dated 28th June, 2021 to the Commissioner of School Education and to the District Inspector of Schools for the benefit of two additional increments for his degree of Ph.D. in Chemistry (Physical). This is also kept pending before the District Inspector of Schools.

Considering the submissions on behalf of the parties, I direct the District Inspector of Schools to

decide the matter of giving two additional increments after giving an opportunity of hearing to the petitioner within a period of eight weeks from the date of communication of this order and to pass a reasoned order by two weeks thereafter and to communicate the same immediately after the reasoned order is passed.

With this observation and direction, this writ application is disposed of.

As no affidavit has been called for, the allegations made against the respondents are deemed to have been denied.

Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
