The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.

The plaintiff in a suit for declaration of title being Title Suit No. 351 of 2021 pending before the 2nd Court of learned Civil Judge(Junior Division), Burdwan is the petitioner of the present application under Article 227 of the Constitution of India. The petitioner is complaining delay in disposal of the application for injunction filed by her in the said suit.

It appears from the record that the said application was filed only on August 16, 2021, therefore the direction as prayed for at this stage for disposal of the said application within a specific time is not warranted.

The defendant/opposite party since has already entered appearance and has filed his written objection to the said application, the learned Trial Judge, keeping in view the nature of the said application, is requested to dispose of the said application as expeditiously as possible in accordance with law without granting any unnecessary adjournment to either of the parties.

C.O. 1786 of 2021 is thus disposed of without any order as to costs.
