1. The learned Counsel for the appellants has submitted that the Item-5.

sg 21-09-2023 Ct. 8 order impugned was complied with on the threat of contempt.

2. But in the absence of any document showing that the said order was complied with on the basis of a contempt or reserving the right to prefer an appeal, we are unable to accept the said submission. The order impugned, in fact, was accepted unconditionally and without any reservation.

3. Once the order is accepted and complied with, the appeal is not maintainable.

4. The appeal and the application accordingly dismissed. However, there shall be no order as to costs. (Prasenjit Biswas, J.) (Soumen Sen, J.)
