The petitioner and the private respondent both are contesting candidates of the Panchayat General Elections, 2023.

The petitioner challenges the candidature of the private respondents on the allegation that the private respondent is an existing contractor of the Panchayat. In support of the said submission the petitioner relies upon the work order issued in favour of the private respondent by the Panchayat Samity in July 2021. On a perusal of the work order it appears that the work in question was to be completed within 180 days from the date of issue of the work order. The time period for completion of the contract is long over.

The petitioner has not been able to produce any document to suggest that the contract of the private respondent is existing.

In view of the above, the contention of the petitioner that the private respondent is an existing contractor cannot be accepted.

The writ petition fails and is hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
