Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner claims that the private respondents and their associates had snatched away a substantial sum on or about 25th June 2025 and threatened that the petitioner along with his family members would be murdered. To that effect, information was furnished which was received by the office of the Superintendent of Police Purba Bardhaman as well as the local police authorities.

State has submitted a report which reflects on enquiry the private respondents also claim that they had given money to the petitioner and the present case is a ploy to not return the said money. Learned advocate appearing for the private respondent nos. 6, 7 and 8, on the other hand, submits that the private respondents have

documents in their custody to show that they had given money to the petitioner.

Be that as it may, since the police authorities are well aware regarding the ground reality so far as the transactions are concerned and the nature of the complaint which has been received, they have drawn up proceedings under Sections 126/135 of BNSS. Police authorities would ensure that no breach of the peace or tranquility takes place. Petitioner is directed to approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate will assess and ascertain regarding the genuinity of the accusations by way of calling for a report from the police authorities and thereafter pass necessary directions as he deems feet and proper.

With the aforesaid observations, the writ petition being WPA 15196 of 2025 is disposed of. There will be no order as to costs.
