The State of West Bengal & Ors.

Mr. Keshab Chandra Das Ms. Aparajita Mondal Mr. Biplab Adak ... For the petitioner Ms. Sipra Majumdar Ms. Sangeeta Roy ... For the State Mr. Sumit Roy ... For the respondents no.2, 3 & 4 Affidavit of service filed in Court today is taken on record.

The petitioner claims to be the son of Ganesh Murmu, a former employee of West Bengal State Electricity Distribution Company Limited (in short "WBSEDCL"), who died-in-harness on 10th April, 2020. The petitioner has applied for his candidature being considered for compassionate appointment. Aggrieved by the reason that such application has not been considered, the petitioner has approached this Court by filing the instant writ petition.

On behalf of the respondents no.2, 3 and 4, it is submitted that by a letter dated 25th October, 2021, the

petitioner has been asked to provide certain particulars as indicated therein. The writ petition was filed on 29th September, 2021 and, as such, the letter referred to by the respondents no.2, 3 and 4 is subsequent to the filing of the writ petition.

The respondents no.2, 3 and 4 and/or their advocate is directed to serve a copy of the letter dated 25th October, 2021 to the advocate for the petitioner within 18th November, 2021.

The petitioner on receiving a copy of such letter dated 25th October, 2021 shall provide the details and particulars as mentioned therein within two weeks from the date of receipt of such letter dated 25th October, 2021.

In the event the petitioner provides the details, the respondent no.4 shall consider the petitioner's application with the details that may be supplied within eight weeks from the date of the details being provided by the petitioner after affording the petitioner a reasonable opportunity to represent his case following the prevailing Covid-19 protocol. The respondent no.4 shall dispose of the petitioner's application by a reasoned order and shall communicate the same immediately upon the passing of such order.

Nothing further remains to be adjudicated in this writ petition. The same is disposed of accordingly without any order as to costs.

Since I have not called for any affidavits, allegations made in the writ petition are deemed to have not been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
