Learned advocate appearing for the petitioner submits that the petitioner is in custody since August 2021 and till date, no witness has been examined. The petitioner is unable to apprise the Court regarding the factum of whether charge has been framed in connection with the case.

Learned advocate for the petitioner is directed to hand over a copy of this revisional application upon Ms. Sreyashi Biswas, learned advocate, who ordinarily appears for the State. Her appointment may be regularised by the concerned authorities.

I have considered the submissions of the learned advocate for the petitioner as well as the State and I find that the petitioner is in custody since August 2021 i.e. more than 21 months. Having considered the period of detention, I am of the view that the learned Special Court should take steps for expediting the progress of the trial. In case there is any noncooperation from the witnesses who represent the government department, the learned trial court would pass

necessary directions upon the concerned Commissioner or the Superintendent of Police.

The prosecution would ensure production of material exhibits and documents on the date so fixed. All efforts must be taken for concluding the trial at the earliest. With the aforesaid observations, the revisional application being CRR 2525 of 2022 is disposed of. Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
