Learned advocate appearing for the State has handed over a copy. According to the police authorities, the property referred to is presently in possession of the petitioner. Records reflect that pursuant to a decree and an execution case having been filed the bailiff being assisted by the police authorities handed over possession in respect of the suit property. There was a G.D. Entry in the police station in respect of the series of events which had taken place.

Presently the police report also reflects that the suit property is in possession of the petitioner.

Learned advocate for the respondent submits that the plot number which was in possession of the private respondent was a different plot number. Be that so, if in respect of the said plot number any direction is passed by the Civil Court and subsequent directions upon the police authorities are given by the concerned Civil Court, police authorities would be bound by such order. Having regard to the steps taken by the police authorities, further pendency of the writ petition is unwarranted.

Accordingly, WPA 16336 of is disposed of.

This Court earlier by an order dated 01.07.2025 directed the Inspector-in-Charge, Baruipur Police Station to be present in Court. Having considered that steps which have been taken, further appearance of the Inspector-inCharge is dispensed with. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
