The concerned respondents have been served twice pursuant to the direction of this court, the last time being as of 2nd May, 2022. However, none of the respondents is present.

The petitioner was given appointment by the Dinhata College, Dinhata, Cooch Behar on a purely contractual basis after his father died on 25th November, 2017. There are two letters on record from the concerned College to the Director of Public Instruction, West Bengal dated 2nd May, 2019 and 2nd March, 2020 by which the Teacher-in-Charge of the College requested to take appropriate action on the part of the D.P.I. for the petitioner's appointment on compassionate ground. According to learned counsel appearing for the petitioner, none of these letters were responded to and the petitioner is now in financial distress since the petitioner's mother is suffering from cancer and needs minimum treatment.

Upon considering the documents on record, W.P.A.16371 of 2021 is allowed and disposed of with a direction on the respondent no.2 being the Director of Public Instruction, West Bengal to consider the two representations of the College dated 2nd May, 2019 and 2nd March, 2020 and dispose of the same by passing a reasoned order after hearing all concerned parties including the petitioner within a period of four weeks from the date of communication of this order. Copy of the reasoned order shall be given to the petitioner within a week from which such order is passed. Needless to say, the petitioner's appointment shall be considered in accordance with the relevant Rules and Notifications. (Moushumi Bhattacharya, J.)
