West Bengal State Electricity Distribution Company Limited (in short, WBSEDCL), the employer, while processing the claim of the petitioner for releasing the benefits of his deceased father has sought for certain documents vide letter dated 25th October, 2021. In terms of the order dated 9th November, 2021, a copy of the said letter dated 25th October, 2021 has been served on the petitioner by WBSEDCL.

It is submitted on behalf of the petitioner that in terms of the letter dated 25th October, 2021, the petitioner is in the process of submitting the documents as sought for by WBSEDCL.

Let the petitioner submit all such documents as indicated in the letter dated 25th October, 2021 to the

extent of the documents available with him to WBSEDCL within 2nd December, 2021. In the event, such documents are filed by 2nd December, 2021, the Divisional Manager, Mogra (D) of WBSEDCL, being the respondent no.5, shall dispose of the petitioner's claim within a period of six weeks from 2nd December, 2021 by a reasoned order, after affording the petitioner a reasonable opportunity of hearing, following the Covid19 protocol. The reasoned order so passed shall be communicated to the petitioner within a period of ten days from the date of passing of the same.

Nothing further remains to be adjudicated in this writ petition. The same is disposed of accordingly without any order as to costs.

Needless to mention that I have not gone into the merits of the matter and the respondent no.5 shall be free to pass his order without being influenced in any manner by the instant order.

Since I have not called for any affidavit, allegations made in the writ petition are deemed to have not been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of necessary formalities.
