Learned advocate appearing for the petitioner submits that the subject matter of the present case relate to 48 bottles of Phensedyl and the present petitioner has been arrested on the basis of statement of co-accused and there has been no recovery from the present petitioner who is in custody presently for 187 days.

Learned advocate for the State opposes the prayer for bail and submits that there are antecedents of the present petitioner who is a history-sheeter.

Be that as it may, having considered the materials appearing against the present petitioner, I am inclined to release the petitioner on bail.

As such the prayer for bail of the petitioner is allowed. Petitioner, namely, Manjarul Choudhury @ Manjurul Chowdhury @ Miya shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge, NDPS Act cum Learned Additional Sessions Judge, 3rd Court, Dakshin Dinajpur, Balurghat.

If on bail the petitioner shall be physically present on each and every date fixed by the learned Trial Court. Petitioner shall not leave the jurisdiction of District of Dakshin Dinajpur without the permission of the learned Special Court. Accordingly, CRM (NDPS) 858 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
