Learned counsel for the petitioner submits that despite a previous order dated December 14, 2022 passed in WPA 26886 of 2022, the WBSEDCL is not giving electricity connection to the petitioner, although the petitioner made several representations.

Learned counsel for the WBSEDCL points out to the said order annexed at page-21 of the writ petition and contends that as per the said order, the petitioner was granted liberty to apply for a fresh electricity connection. No such application, in proper format, having been filed by the petitioner, the WBSEDCL could not process the same.

There is justification in the contention of learned counsel for the WBSEDCL, insofar as this court, on the

previous occasion, had granted liberty to the petitioner to "apply" for a fresh electricity connection at the premises and upon compliance of all formalities and due process of law, directed the WBSEDCL to give such connection to the petitioner.

The petitioner having not done so, the cause of action for the present writ petition is premature. Accordingly, WPA 15270 of 2023 is disposed of by reiterating that the petitioner will be at liberty to make a proper application in appropriate format, as sanctioned by law and procedure, for a fresh electricity connection. If so made, the WBSEDCL shall raise a quotation accordingly and, upon compliance of all formalities, the WBSEDCL shall give such connection to the petitioner, preferably within a fortnight from the date of compliance of such formalities.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
