19.07.2022 sdas rejected C.R.M.(DB) No. 2380 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Bansdroni Police Station Case No. 65 of 2019 dated 04.04.2019 under Sections 302/34 of the Indian Penal Code.
And In Re : Forman Sk. @ Faruk ..... petitioner Sk. Toslim Ali Mr. Saba Parween ... for the petitioner Mr. Sudip Ghosh Mr. Apurba Kumar Datta ... for the State Learned Counsel appearing for the petitioner submits that the petitioner prays for bail. He is in custody for more than four years. There is slow progress in the matter. Learned Counsel appearing for the State opposes the prayer for bail. He submits trial is in progress. We have considered the materials on record prima facie disclosing involvement of the petitioner in the alleged crime. Trial is in progress.
Under such circumstances, we are not inclined to grant bail to the petitioner.
The application for bail is, thus, rejected. However, in view of protracted period of detention suffered by the petitioner, we direct the trial court to expedite the trial and conclude the same at an early date preferably
within a period of one year from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
