The instant application under of the Constitution of India is at the instance of the defendants in a suit for declaration of title and injunction which is directed against Order dated April 09, 2024 passed by the 3rd Court of the learned civil Judge (Junior Division), Serampore, District : Hooghly in the said suit being Title Suit No.418 of 2022.

The learned Trial Judge by the order impugned has dismissed an application filed by the petitioners to have water connection in the suit premises.

The petitioners, by the said application, have sought for a direction upon the P.H.E. Authority to provide such water connection. The said Authority is not a party to the suit, as such, the direction as prayed for is a misconceived one.

The order impugned, therefore, does not call for any interference.

C.O. 2233 of 2024 is dismissed accordingly without any order as to costs.
