The petitioner has alleged that the respondent nos. 5 and 6 have been continuously disturbing and torturing the petitioner. The respondent nos. 5 and 6 are the son and the daughter-in-law of the petitioner. The allegation is that the Inspector-in-Charge, Bally Police Station has failed and neglected to take action on the complaints filed by the petitioner against the respondent nos. 5 and 6.

Reliance has been placed on an order passed by the Maintenance Tribunal in Case No. 29 of 2021. The Inspector-in-Charge, Bally Police Station was directed to ensure protection of the life and property of the petitioner and prevent victimization of the petitioner.

The police authorities have filed a report from which it appears that the Sub-Divisional Officer,

Sadar, Howrah was approached by the petitioner under the Maintenance and Welfare of Parents and Senior Citizens Act. Orders were passed from time to time by the Tribunal upon the Inspector-in-Charge, Bally Police Station to inquire in to the matter and file a report before the Sub-Divisional Officer. The Sub-Divisional Officer passed an order on September 8, 2021 with a direction upon the police authorities to protect the life and property of the petitioner who is a senior citizen.

A report has also been filed before this court from which it appears that an FIR had been registered and Bally P.S. Charge-sheet No. 109 of 2021 dated May 31, 2021 was also filed. Respondent nos. 5 and 6 appeared before the learned CJM, Howrah and were released on bail. The Tribunal has already passed necessary orders for police protection. Under such circumstances, nothing remains to be decided in the writ petition. The order of the SubDivisional Officer shall be complied with by the police authorities.

The writ petition is disposed of.

There shall be no order as to costs.
