Learned counsel for the petitioner, in his usual fairness, submits on instruction that an appeal had been filed by the petitioner before a wrong Forum, under the Right to Information Act, 2005 (Act of 2005).
Accordingly, the petitioner seeks liberty to file the second appeal contemplated under the said Act of 2005 before the appropriate Forum. In such view of the matter, WPA No.
15285 of 2023 is disposed of with liberty to the petitioner to file a regular second appeal under the Act of 2005 before the appropriate competent Forum.
If such an appeal is filed, the same will be decided in accordance with law without being
influenced in any manner by any of the observations made herein.
Since no affidavits were invited from any of the respondents, it is deemed that the respondents have not admitted any of the allegations made in the writ petition.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
