28-06-2024 (ct. no.28) KOLE CRM (NDPS) 1015 of 2024 In re: An application for bail under Section 439 of the Code of Criminal Procedure in connection with Baishnabnagar Police Station Case No. 542 of 2023 dated 13.08.2023 under Section 21(c)/25/29 of the NDPS Act.

- A n d - In the matter of : Majibar Sekh @ Majibar SK @ Majibur .... Petitioner.

Mr. Santanu Talukdar, Ms. Shalini Bairagi, ... For the Petitioner.

Mrs. Faria Hossain, Mr. Mainak Gupta, ... For the State.

The petitioner renews his prayer for bail which was rejected by a Coordinate Bench by an order dated January 31, 2024 passed in CRM (NDPS) 2087 of 2023.

The petitioner says that he is innocent. There was no recovery from him.

Learned Advocate for the State says that there is sufficient incriminating evidence against the petitioner. The petitioner is one of the persons who finalized these transactions. He is also the receiver of the contraband items.

Since the prayer of the petitioner was rejected on merits as recently as in January 2024, we are not inclined to entertain his prayer for bail, also keeping in mind that commercial quantity of contraband is involved.

CRM (NDPS) 1015 of 2024 is, thus, dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Apurba Sinha Ray, J. ) ( Arijit Banerjee, J. )
