Narkeldanga Police Station has filed a report in the form of instructions addressed to the State Advocate dated 14th September, 2022 be taken on record.

It is submitted that Narkeldanga Police Station has only asked the petitioner to ensure that the construction is strictly as per the sanction plan of the Kolkata Municipal Corporation. It is further submitted that the said request from the police had come on a complaint by a third person.

In the above circumstances, the petitioner shall carry out the construction strictly in accordance with the provisions of the sanctioned building plan of the Kolkata Municipal Corporation.

If any person is aggrieved by the petitioner's construction, he may take out appropriate civil proceedings in accordance with law.

Narkeldanga Police Station shall, however, not interfere with the construction in question and ensure that there is no breach of peace in the area. With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
