The petitioner has completed B.Sc. Nursing Course from ITM University, Gwalior, Madhya Pradesh in the academic sessions 2018-2022 and has registered himself with the Madhya Pradesh Nursing Council.

The grievance of the petitioner is that his application for reciprocal registration has been rejected by the West Bengal Nursing Council.

Mr. Abir Sarkar, learned advocate for West Bengal Nursing Council submits that the Indian Nursing Council (hereinafter referred to as the 'INC' in short) by a notification bearing no. bearing F.No.22-10/Univ.-2019-INC dated April 18, 2019 has laid down the guideline regarding the examination and according to the said guideline, the B.Sc. Nursing Course would be of four years but the course which the petitioner has pursued was structured in 8 semesters, thus offends the guideline of INC for which the West Bengal Nursing Council is not inclined to allow the prayer of the petitioner for reciprocal registration.

Mr. Nilotpal Chatterjee, learned counsel for the INC submits that by a subsequent notification dated July 05, 2021 INC has revised the regulations and curriculum for B.Sc. (Nursing) Programme whereby the said course has been structured on semesters.

Mr. Pankaj Haldar, learned advocate for the petitioner referring to the orders of the Co-ordinate Benches submits that refusal of the West Bengal Nursing Council to issue reciprocal registration of similarly placed candidate was not sustained in the said orders.

Having heard the learned counsel for the parties and on perusal of the record, it appears that the petitioner had pursued the course in the academic session 2018-2022, during the said period, the INC had brought the change in the structure of the said course vide notification dated July 05, 2021, therefore, refusal of the prayer of the petitioner for reciprocal registration on the ground that the course which the petitioner had pursued was not structured according to INC guideline is not sustainable.

In the aforesaid backdrop, the Registrar, West Bengal Nursing Council, the respondent no. 4 herein is directed to provide reciprocal registration to the petitioner within a period of six (6) weeks from the date of communication of this order, subject to compliance of all necessary formalities. W.P.A. 15283 of 2025 is disposed of with the above terms without any order as to costs.
