The respondents are not represented.

The petitioner alleges that the private respondents have raised construction in the plots in question recorded as doba and suna respectively without conversion of the same. The petitioner submitted a representation before the concerned authority in this regard on 28th May, 2025 and seeks consideration of the same.

By an order passed on 11th November, 2025, this Court directed the private respondents to produce the sanctioned plan of the relevant construction. The private respondents are not represented today.

Be that as it may, since the representation submitted by the petitioner before the concerned authority is pending, the Pradhan, Purba Ramnagar Gram Panchayat, being the 8th respondent herein, is directed to consider and dispose of the same within six weeks from the date of communication of the order upon granting reasonable opportunity of hearing to all concerned including the petitioners and the private respondents, in accordance with law.

The decision taken by the authority shall be communicated to the parties within a week thereof.

In the event the construction raised by the private respondents is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law.

It is made clear that the issue of alleged encroachment of the petitioner's land shall be dealt with by the appropriate civil forum. The 8th respondent shall only deal with the allegation of raising construction without conversion of the plots in question.

The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
