Learned counsel for the petitioner submits that there has been further development in the matter to the effect that it has been agreed upon by the petitioner and the victim that they shall marry when the victim attain majority. Learned counsel for the defacto complainant submits, on instruction, that the defacto complainant has no objection if the petitioner is enlarged on bail. State produces the Case Diary and opposes the prayer.

It appears that the petitioner is in custody for about 172 days. Charge sheet has been submitted. The defacto complainant has raised no objection to the prayer for bail. Further detention of the petitioner is not required for the purpose of custodial interrogation.

Accordingly, the prayer for bail is allowed.

Accordingly, the petitioner shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Tamluk, Purba Medinipur subject to condition that he shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event the petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.

The application for bail, being CRM (SB) 83 of 2024, is, thus, disposed of.
