1. Petitioners seek terminal benefit. It appears that the service of the employees was regularized from 1st March, 2006 and Pension Payment Order was issued from the said date.

2. According to the petitioners, they joined service in the year 1986 and accordingly, they ought to be provided benefit on and from the first date of their joining in service and not from the date of regularization.

3. The Court is of the opinion that the issue as to whether the Pension Payment Order has been issued from the proper date or not cannot be adjudicated and looked into in the contempt proceeding.

4. In view of the above, there is no requirement of proceeding with the contempt application any further. The contempt application stands disposed of.

5. It will be open for the petitioners to challenge the action of the respondent authority granting the terminal benefit from a later date before the appropriate forum in accordance with law, if so advised.

6. Urgent photostat certified copy of this order, if applied for be supplied to the parties upon compliance of all requisite formalities.
