Learned counsel for the petitioner argues that in spite of the objection taken by the petitioner, the WBSEDCL forcibly installed about six electricity poles on the petitioner's land, to the detriment of the petitioner. Learned counsel places reliance on the representations given by the petitioner in that regard, annexed to the writ petition.

Since law provides that the concerned District Magistrate is the appropriate authority to decide such objections, WPA 15690 of 2022 is disposed of by granting liberty to the petitioner to refer the dispute to the concerned District Magistrate having territorial jurisdiction over the concerned area.

Upon such reference being made, the District Magistrate shall decide the said dispute upon giving

adequate opportunity of hearing to all concerned and in accordance with law, as expeditiously as possible, preferably within eight weeks from the date of such reference and pass appropriate orders.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
