Learned counsel appearing on behalf of the petitioner submits as follows. There were certain incurable defects in the representation and consequently, in the writ petition filed by the petitioner. The petitioner's grievance that a distance of not less than 1.5 metres shall be kept clear between protected works and the edge of such enclosure wall or pit as contained in Section 138 (5) of the Petroleum Rules 2002 has not been reflected in the representation or in the writ petition. Accordingly, the petitioner would not like to press this application and would instead make a fresh representation taking up all the points distinctly. On such prayer of the learned counsel appearing for the writ petitioner, the same is disposed of as not pressed

with the liberty granted to the petitioner to make a fresh representation.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
