In Re: CAN 2 of 2023 This is an application praying for condonation of delay for about 4 years 7 months in filing an application for restoration of a writ petition. The writ petition was dismissed on November 26, 2018. The restoration application filed on December 18, 2023.

Mr. Raja Ram Banerjee, learned counsel, appears for the State-respondents.

Learned State counsel prays for an opportunity to file an affidavit-in-opposition considering the quantum of delay.

Affidavit-in-opposition shall be filed on or before October 15, 2023. Affidavit-in-reply, if any, thereto shall be filed on or before November 23, 2023.

The application shall appear under the heading "Application" in the Combined Monthly List of December, 2023.
