1. Let affidavit-of-service, as filed in Court, be kept on record.
2. The application of the petitioners under Section 14 of the Securitization and Reconstruction of the Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as the "SARFAESI Act"), has been pending since 2015.
3. Mr. Saha, learned Advocate appearing for the petitioners, fairly submits that the reason for the pendency may not be ascribable in its totality to the respondent no. 2. The pendency of the application for the last ten years clearly defeats the purpose of the said Act, which provides for strict timelines to the respondent no. 2, to dispose of an application under Section 14 of the SARFAESI Act within a period of thirty days and
after extension, within a period of sixty days from date.
4. In view of the aforestated, the Bank is granted liberty to make an appropriate application within December 20, 2025, before the respondent no. 2, who will proceed to deal with the same in accordance with law and dispose it of within the statutorily mandated period under the said Act.
5. With the aforestated direction, the writ petition is disposed of.
6. There shall, however, be no order as to costs.
7. Since no affidavit has been called for, the allegations contained in the writ petition are deemed to be denied.
8.Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
