The State of West Bengal and anr Mr. Sarjati Datta............for the State Nobody appears on behalf of the petitioner on call. Even on earlier occasion no one represented the petitioner, nor accommodation sought for.

Report filed by the State is taken on record. The petitioner by filing this application prays for quashing of proceeding of M.F Case no. 88141 of 2015 arising out of Girish Park P.S. Case no. 461 dated 19.12.2015 under section 401A of the Kolkata Municipal Corporation Act, 1980 pending before the court of learned 4th Municipal Magistrate, Calcutta Municipal Court.

Upon perusal of the report along with the copy of the judgment passed by the learned Municipal Magistrate on 28.09.2016 appears the accused Sushil Kumar Hetamsaria was found guilty of an offence punishable under sections 392, 336(1), 610 of the Kolkata Municipal Act and he was directed to pay a sum of Rs. 500/-, in default simple imprisonment for 5 days only.

Under the above facts and circumstances, the instant case has become infructuous.

Accordingly, the instant revisional application being CRR 2254 of 2016 is thus dismissed being infructuous.

Interim order, if any, stands vacated.

Let the order be communicated to the Ld. Court below for information.

Liberty is granted to all parties to act in terms of the copy of this order downloaded from the official website of this court.
