Mr. Rajesh Singh ... for the respondent no.1/insurance company. It was brought to the notice of this Court that the Trial Court Records pertaining to MAC Case No.155 of 2008 was not on record which otherwise should have been considered prior to the order being passed in FMAT 734 of 2016. Accordingly, the order dated 13th March, 2025 is recalled.

The learned Registrar (Judicial Service) is directed to call for the Trial Court Records in the instant appeal from the concerned trial court.

The department is directed to place the Trial Court records before the Court on the next date of hearing. Next date be fixed on 28th April, 2025.

Copy of this order be communicated to the office of the learned Registrar (Judicial Service) for due compliance.
