Learned advocate appearing for the petitioner submits that, a co-accused was granted bail by the Coordinate Bench. She refers to the period of detention of the petitioner. Learned advocate appearing for the State submits that, a jacket containing blood stains was recovered from the possession of the petitioner. Moreover, an amount was also recovered from the petitioner.

Considering the materials in the case diary and considering the involvement of the petitioner in the incident, we are unable to hold that the petitioner is on the same footing as that of the co-accused, who was granted bail. Consequently, we are unable to grant bail to the petitioner.

Accordingly, prayer for bail is rejected and the application being CRM 6644 of 2021 is disposed of. (Debangsu Basak, J.) (Ananda Kumar Mukherjee, J.)
