The writ petitioner has prayed for a direction for conducting investigation by the independent agency by verifying the C.C.T.V. footage of Raninagar Police Station, Murshidabad from 30th May, 2019 to 31st May, 2019. An FIR was lodged against the husband of the petitioner for the offence under Sections 21(C)/29 of the Narcotic Drugs and Psychotropic Substances Act by the Raninagar Police Station being Crime Case No. 240 of 2019 dated May 30, 2019.

It is submitted by the petitioner that after registration of the case, the petitioner was arrested and now the police has completed the investigation and the case is under trial stage before the learned Trial Court. This Court finds that there is no justification for referreing the matter to an independent agency for

investigation as the police has already completed the investigation and submitted chargesheet and the matter is at trial stage. As the petitioner will get an opportunity to adduce his evidence during the trial to prove his defence, hence no order can be passed in the instant writ petition.

WPA 14388 of 2019 is disposed of.
