Mr. Jaladhi Das ... for the State < This is an application under Article 226 of the Constitution of India wherein the writ petitioner is challenging the order dated December 12, 2019 passed by the Regional Transport Authority rejecting the extension of the route as prayed for by the petitioner. The main contention of the petitioner is that the principle of natural justice was not followed.

Mr. Sen, learned Additional Government Pleader appearing on behalf of the State fairly submits that the petitioner had not been heard before passing the impugned order.

In light of the above submission, the order dated December 12, 2019 passed by the Regional Transport Authority is quashed and set aside with a direction upon them to consider the representation of the writ petitioner and after granting an opportunity of hearing to the petitioner pass a reasoned order within six weeks from date. The reasoned order is to be communicated to the

petitioner within a period of two weeks from the date of passing of such reasoned order.

With the above direction, this writ petition is disposed of.

Since no affidavit has been called for, allegations made in the writ petition are deemed not to have been admitted.

Urgent certified copy of this order, if applied for, be handed over to the parties on usual undertaking. (Shekhar B. Saraf, J.)
