The said report does not disclose any provision of law empowering the concerned authority to transfer the petitioner from the post of Anganwadi Worker at Swaruppur Milani Pathagar to Humaipur.

It further appears that certain allegations were made against the petitioner and that the transfer order was issued on the ground of her misbehaviour in the discharge of duties. Prima facie, the transfer order appears to be punitive in nature. At the initial stage, this Court was inclined to stay the operation of the transfer order. However, it is evident that the petitioner did not

join at the transferred post at Humaipur pursuant to the transfer order and instead chose to remain at her residence without discharging her duties at the transferred place till date.

In view of the aforesaid facts and circumstances, and without passing any mandatory order interfering with the transfer order dated March 5, 2025, liberty is granted to the petitioner to make a representation before the Child Development Project Officer, Hariharpara, CDS Project, within a period of seven days from the date of this order. The said authority shall consider the petitioner's prayer for reconsideration of the transfer order and pass a reasoned decision thereon. If such prayer is allowed, the petitioner shall be permitted to resume her duties at Swaruppur Milani Pathagar. The entire exercise shall be completed within a period of one month from the date of communication of this order. Accordingly, WPA 15345 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
