2) Petitioner being an Assistant Teacher made application for transfer on Utshasree portal on 28th August, 2022 since she was suffering from renal disease. Relying on a document at page 40 of the writ petition, it is submitted that petitioner was medically examined in September-October, by medical expert and nearly three years have passed in the meantime.

3) Respondents are represented by learned advocates who have submitted that due to

constant treatment and care health condition of the petitioner may have improved.

4) Learned advocate for the petitioner submits that petitioner is ready to appear before the medical expert again for re-examination.

5) Having considered the submissions made on behalf of the parties, the District Inspector of Schools (SE), Murshidabad being respondent no. 8 is directed to obtain medical report from the concerned Chief Medical Officer of Health/ Medical Board on medical examination of the petitioner by four weeks from date of communication of this order. In the medical report concerned Chief Medical Officer of Health/ Medical Board is required to opine considering present health condition of the petitioner whether petitioner is required to avoid long distance journey or not. If medical report justifies transfer of the petitioner, respondent no. 8 shall forward transfer application of the petitioner along with medical report to the Secretary of West Bengal Central School Service Commission being respondent no. 5 by fortnight thereafter. On receipt of transfer application and medical report, respondent no. 5 shall decide the transfer application by six weeks thereafter. Decision to be taken by respondent

no. 5 shall be communicated to the petitioner by fortnight thereafter.

6) Writ petition stands disposed of, without any order as to costs.

7) However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal and entire process shall be completed on off-line mode.

8) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
