-vsThe State of West Bengal & Ors.
AR(C) Mr. Nikhil Kumar Gupta ...for the petitioners Mr. Soumitra Bandyopadhyay Mr. Subhasis Bandyopaqdhyay Mr. Priyabrata Batabyal ...for the State By filing the instant writ petition, the writ petitioners have prayed for issuance of an appropriate writ of mandamus upon the respondent no.3 for consideration of their prayer as made under cover of their advocate's letter dated May 28, 2024, a copy whereof is annexed to page 27 of the writ petition. In course of hearing, learned advocate for the writ petitioners submits before this court that it is the grievance of the writ petitioners that recording of names in plot nos. 21, 312,609,611 and 1218 held in the khatian no.140 in the Mouza Angaria (J.L. No.74) has not been done in accordance with law for which the writ petitioners served a notice upon the respondents no.2 and 3, but in vain.
Learned advocate for the State, however, submits that the instant writ petition is not maintainable, since by filing the instant writ petition, the writ petitioners are making an attempt to correct the record of rights which is not in the domain of this court under the West Bengal Land Reforms Act, 1955.
On perusal of the entire materials placed before this court and after hearing learned advocates for the contending parties, this court, while disposing of the instant writ petition, directs the respondent no.3 to consider the letter dated May 28, 2024 as written by the petitioners' advocate, Sri Diptendu Mandal, after hearing the petitioners and the private respondents and all other interested parties as he may deem fit and proper by passing a reasoned order and communicate the same to the writ petitioners as well as the other interested parties in such hearing by speed post with AD.
The entire exercise is to be completed by the respondent no.3, BLLRO, Joypur, district Bankura, by the last date of December 2024.
The respondent no.3 is directed to act on the server copy of this order.
The time limit as fixed by this court is peremptory and mandatory.
With the above observations, WPA No.16349 of 2024 stands disposed of.
All parties are to act on the server copy of this order duly downloaded from the official website of this court.
Certified copy of this order, if applied for, shall be made available to the parties.
