The contention of the wife is that the distance between Hooghly and Purulia is almost 250 kilometers and the petitioner would have to travel 500 kilometers on one day, to attend court at Purulia.

It is further submitted that Purulia is not a developed area. She cannot stay overnight as good hotels are not available.

Learned advocate for the husband submits that the petitioner wife is a working lady and her workplace is at Durgapur. The husband who resides in Bandel, would not have any objection if the suit is transferred to the court of a competent jurisdiction at Durgapur.

Thus, this court finds the approach of the husband to be reasonable. Justice would be subserved, if the suit is transferred to Durgapur. The learned District Judge, Purulia shall transfer the Matrimonial Suit No.97 of 2023 to the court of the learned District Judge, Paschim Bardhaman. The learned District Judge, Paschim Bardhaman shall hear the matrimonial suit himself, upon receipt of the records. The learned transferee Judge, upon receipt of records, shall issue notices to the parties and proceed with the adjudication.

The application stands disposed of accordingly. All the parties are directed to act on the basis of the server copy of the order.
