Rahim Badsha @ Rohim v. The State Of West Bengal
30.07.2025 Court No.28 Item No.58 ssi CRM (A) 2387 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Baishnabnagar PS Case No.149 of 2025 dated 13.02.2025 under Sections 179/180/111(3)/111(4)/61(2) of the BNS, 2023. And In the matter of: Rahim Badsha @ Rohim ....Applicant/Petitioner.
Mr. Arup Kumar Bhowmick ...for the petitioner Ms. Shaila Afrin Mrs. Manasi Roy ..for the State Learned counsel appearing on behalf of the petitioner submits that apart from the statement of a co-accused, there is no other incriminating material available against the petitioner. Charge sheet has been submitted.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail, relies on the case diary and the report. She submits that other than the statement of the co-accused, there are online transactions between the petitioner and the principal accused. In any event, proclamation has been issued against the present petitioner.
In view of the incriminating materials available in the case diary against the petitioner and the fact that proclamation has been issued against him, I am not inclined to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
