Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Mr. Koushik Kundu, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioner draws the attention of the Court to the order dated 11.02.2020 which reflects that the petitioner was granted bail. Learned advocate submits that subsequently for miscommunication, the petitioner was absent and the learned trial court was pleased to issue warrant of arrest on 23.03.2023. The execution return for the said warrant of arrest has been fixed on 01.12.2023.

In view of the undertaking given by the learned advocate appearing for the petitioner who submits that henceforth the petitioner would be available before the court on the date so fixed, I direct the learned Additional Chief Judicial Magistrate, Kandi, Murshidabad that in case the petitioner appears before the court by 21.07.2023 and the records reflect that he is already on bail, he may be allowed to

continue on the same bail and bond subject to the condition that the learned ACJM would exercise his discretion by imposing condition for ensuring his appearance in future dates. In case, the petitioner is unavailable within the aforesaid date, then on and from 22.07.2023, the learned trial court would be at liberty to exhaust harsher process of law for compelling his appearance before the court. With the aforesaid observations, the revisional application being CRR 2394 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.
