Kausik (Rejected) CRM (NDPS) 860 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1531/2023 dated 02.12.2023 under Section 21(C)/27A/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 2 years and till date only charge has been framed and there has been no progress in the trial of the case. As such the petitioner on any stringent condition may be released on bail.

Learned advocate for the State, on the other hand, submits that the State would examine 13 witnesses in order to prove its case.

Having considered that the subject matter of the case relate to recovery of 680 Gms of Brown Sugar, I am not inclined to release the petitioner on bail.

Accordingly, CRM (NDPS) 860 of 2025 is dismissed.

Learned Trial Court is directed to examine the seizure list witnesses within 3 months from the next date so fixed. Petitioner will renew his prayer for bail after the examination of the seizure list witnesses are over. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
