Petitioner has approached this Court as he did not receive any assistance from the police authorities. Petitioner complains of unauthorized construction. Petitioner at the relevant point of time informed to the Inspector-in-Charge, Kandi Police Station.

State has submitted a report. Report reflects that a dispute was existing and a quarrel was picked up at the relevant point of time between the petitioner and one Kanchu Ghosh. On enquiry, police authorities were of the opinion that the dispute was of such nature that without the aid of a Court Order they were unable to take steps.

However, the police authorities at the relevant point of time drew up proceedings under section 107/116 of the Cr.P.C. The said incidents complained were on or about August 2023.

Having considered that substantial time has passed since then, I direct in case the petitioner is aggrieved by act and/or action of the police authorities or the Administration or the Municipal Authorities, petitioner would approach the jurisdictional civil court or criminal court which would address the issue of grievance of the petitioner and if on assessment is of the view that there are genuinity in the accusations, they would pass necessary directions upon the police authorities to act in accordance with law.

With the aforesaid observations WPA 16352 of 2024 is disposed of.
