Mr. Kishore Mukherjee Mr. Soumyajit Mukherjee ... For the Petitioner Since the petitioner seeks expeditious disposal of M. Case no. 71/2021 pending before the learned Judicial Magistrate, 6th Court at Sealdah, the matter may be disposed of without service of notice upon the opposite parties.

Learned counsel for the petitioner submits that the application under Section 125 of the Code of Criminal Procedure was initially allowed ex parte since the opposite party did not contest the application. The said order was set aside subsequently and the application for interim maintenance is pending since then. The petitioner is suffering immensely due to such delay in disposal of the matter.

Upon consideration of the submission made on behalf of the petitioner, this Court directs the learned Judicial Magistrate, 6th Court, Sealdah to dispose of the application for interim maintenance within one month from the next date of hearing fixed before him.

It is submitted by the learned counsel for the petitioner that the 6th Court of the learned Judicial Magistrate, Sealdah is lying vacant at present. In that event the learned Magistrate who is in charge of the said Court shall deal with the

application for interim maintenance of the petitioner and dispose of the same within the stipulated time frame. Learned trial Court is further directed to dispose of the case being M. Case no. 71/2021 as expeditiously as possible without granting any unnecessary adjournment to either of the parties, in accordance with law.

The revisional application being CRR 2559 of 2024 is disposed of.
